The last abortion clinic in Kentucky will remain open following a court ruling.
A federal judge ruled Friday that a state law on licensing agreements is unconstitutional. Abortion clinics in the state of Kentucky were required to maintain deals with ambulances and hospitals to transport women in the event of complications.
EMW Women’s Surgical Center in Louisville sued last year, claiming the agreements posed a burden on a woman’s ability to get an abortion. A judge ruled that the transfer agreements violated due process under the 14th Amendment. Under the new ruling, the ACLU says another facility can start performing abortions.
