A motion to dismiss the indictment against Hopkinsville Police Lt. Jefferson Alexander has been denied by Christian Circuit Judge John Atkins.
According to court documents, Judge Atkins clarifies that the argument to dismiss the case or indictment against Alexander ‘lacks substance’ and the court finds the Grand Jury process that resulted in an indictment to be intact. Further, he states the grand jury report shows that the decision to indict was based on evidence, not improper motive.
The motion to dismiss was denied and the case was continued to May 20 for a pretrial hearing.
As previously reported, a grand jury indictment for first-degree perjury stems from an FBI investigation which brought allegations that on August 17th, 2012, Lt. Alexander gave false testimony on three occasions when he was the only sworn witness before a grand jury that indicted former Hopkinsville City Councilmember Ann Cherry on charges of tampering with a witness, tampering with public records, and second-degree official misconduct.
