Judge grants bond motion in drug overdose manslaughter case

Christian Circuit Judge Andrew Self granted a bond motion Monday morning for 21-year old Seth Henderson, the man charged with manslaughter and fentanyl trafficking in connection with a 2021 fatal drug overdose.

Henderson’s co-defendant, Joshua Long, entered a guilty plea in February of last year to an amended charge of possession of a controlled substance as part of a plea deal that required him to testify against Henderson, should he go to trial.

Henderson is accused of selling narcotics to 23-year old Corbin Bowling of Crofton, who would die of a drug overdose in early 2021.

The charges against Henderson were dismissed in May after attorney Olivia Adams successfully argued to Judge Andrew Self that Commonwealth’s Attorney Rick Boling knowingly or intentionally presented false or misleading testimony to the grand jury regarding text messages in the case. There was testimony in the original grand jury proceedings about a text message exchange that all parties later acknowledged Henderson was not a party to and that incorrect dates were given.

Adams argued Monday that the entire time Henderson was out following the dismissal, he never got in trouble with the law and maintained a job.

Special Prosecutor Nate Beard opposed Henderson’s release, alleging he continued to sell drugs after knowing Bowling had overdosed.

Ultimately, Judge Self granted Henderson’s release based on his good conduct while out previously, but did place several restrictions including drug testing, an ankle monitor and no contact with the victim’s family.

Another hearing was scheduled for March 22, when the parties will either resolve the case or set a trial date.
