Proceedings continued as information sought in East Ninth St. Dollar General shooting

Discussions on how to proceed in an attempted assault case against to men were held in Christian Circuit Court Wednesday, and proceedings were continued as more information is sought.

Trial is already set in the cases against Winston Morrow and Donte White, who are both charged with attempted first-degree assault and first-degree wanton endangerment, but there could be issues going forward concerning the prosecution and having them tried together.  Defense attorney Michael Thompson says both men are claiming self-defense against each other, so he can’t see how they could be tried together.

Hopkinsville police allege Morrow and White got into an argument in the East Ninth Street Dollar General in August of 2021, and gunfire was exchanged as they left the building. No one was injured in the incident.

Judge Andrew Self questioned whether Commonwealth’s Attorney Rick Boling will be able to prosecute both cases, or if it would become a conflict—Boling says he intends to find out more and report back to the court on what he can and can’t do.

Judge Self set a pretrial hearing for December 21, with the hope of having clarification at that time.
