Judge revokes probation for Sam Miller

Probation was revoked Wednesday morning in Christian Circuit Court for Sam Miller, one of the four men who took plea deals for their roles in the 2014 sexual assault of a male juvenile at a party on Lafayette Road.

Miller entered a guilty plea in August of 2016 to complicity to wanton endangerment, complicity to tampering with evidence and distribution of matter portraying a minor in a sex performance. The deal came with a 13-year sentence, but it was noted Miller would be eligible to apply for shock probation after a year.

He was granted shock probation in August of 2017.

Miller violated conditions of his probation when he was arrested for DUI on Fort Campbell Boulevard in Oak Grove April 21 and it was noted in Circuit Court Wednesday that Miller had been charged in June for having an empty liquor bottle in his car when stopped for violating noise regulations.

Miller’s girlfriend testified that bottle was empty when he got it, as she was going to use it for a craft.

He later tested positive in June for alcohol in his system and that preceded his arrest for probation violation.

Defense attorney Bill Deatherage had Miller’s probation officer, Megan Goss, testify and she recommended that Miller participate in an inpatient alcohol treatment program.

She says Miller admitted to having an alcohol addiction and he testified Wednesday that he was self-medicating after his ex-girlfriend left him and took their child with her. Miller said he was willing to undergo alcohol treatment, but Assistant Attorney General Jim Lesousky argued he knew the conditions of his probation when he chose to drink.

After hearing about 20 minutes of testimony and arguments, Judge John Atkins revoked Miller’s probation and placed him in the state’s custody to serve out his 13-year sentence.

Miller’s DUI case is still pending in Christian District Court.
