Assault charge against Carson Moore dismissed without prejudice

The Todd County man accused of nearly beating his wife to death in an assault at their Old Trenton Road home last summer is no longer on an ankle monitor or under any conditions of bond after having his charge dismissed without prejudice Wednesday morning in Todd Circuit Court.

The deadline to have evidence testing results ready for trial came and went and acting Commonwealth’s Attorney Justin Crocker says the state crime lab still hasn’t finished analyzing blood found on Carson Moore’s shirt and bed sheet to determine if it was his wife Johnnie’s or if it was his own blood.

Defense attorney Ken Haggard opposed Crocker’s request for a continuance of trial to await testing results, saying Moore has been waiting over a year for his day in court.

Judge Tyler Gill gave Crocker the option of dismissing without prejudice or proceeding to trial next month with the information he has available now. Crocker said he’d dismiss with the opportunity to take the case back to the grand jury when the crime lab completes its analysis.

Judge Gill granted the motion to dismiss, saying he wouldn’t force Moore to remain under indictment and bond conditions due to the crime lab’s backlog.

Kentucky State Police investigated and alleged that the Moore struck his wife multiple times, causing severe head injuries that put her in Skyline Medical Center in Nashville. Haggard has cited a medical history showing Johnnie Moore has a history of seizures and believes a fall or multiple falls could explain the injuries.
