There’s still no trial date set for the five suspects charged in the September, 2018 murder of Jerry Robertson on Stateline Road near Allensville as attorneys wait for additional evidence.
Daniel Westbrook, Douglas Cropper, Timmie Latham, Faith Martin and Brandi Scruggs appeared in Todd Circuit Court Wednesday morning and Commonwealth’s Attorney Neil Kerr says Kentucky State Police is working on getting information turned over to the defense lawyers, including phone records.
KSP will also be turning over copies of a letter that Cropper wrote to investigators, according to Kerr.
With all of the evidence still not in, Judge Tyler Gill decided to set another hearing for April 17th, when a trial date could be set.
Scruggs’ attorney confirmed he won’t be seeking a special prosecutor in the case. Kerr previously served as conflict counsel for Scruggs on an unrelated matter, but everyone involved agreed it doesn’t represent a problem.
Westbrook allegedly shot Robertson three times after Scruggs drove the victim in a car to an area just north of KY 848 on Stateline Road. A pickup occupied by Westbrook and the three other suspects passed the car and then stopped in their path of travel, according to the KSP warrant, which says all five suspects fled in the pickup after Westbrook fired the weapon that Cropper provided to him.
Westbrook is charged with murder, while the other four are charged with complicity to murder and additional related counts.
