Deovion Day was found not guilty of murder in Christian Circuit Court on Tuesday for his connection to the 2021 Princess Theater shooting.
Day was facing charges of murder, second-degree manslaughter and fourth degree assault. In 2021 a gunfight reportedly occurred between Zamarius Humphries and Jaquavian Spencer after a party. In response, Day allegedly attempted to shoot Spencer. Gteria Acree was injured and Aniyah Collins was killed during the gunfight.
Day’s trial began Monday morning and concluded Tuesday afternoon with closing statements and the jury’s verdict. During closing, Day’s defense attorney Daniel Whitley claimed there was not enough proof to convict Day.
Whitley says a medical examiner from the Kentucky State Police Department placed the shooter at a location that Day was not at during the incident. Whitley says Day is taking the fall for someone else’s actions.
Commonwealth’s Attorney Maureen Leamy says the video evidence shows someone who has the same physical build as Day at the party and in the parking lot at the time of the shooting.
After a couple hours of deliberation, the jury found him not guilty of the three charges, Circuit Judge Andrew Self read the ruling.
Day still faces a charge of possession of a handgun by a convicted felon but Leamy says she may dismiss the charge. Day will reappear in court on December 16.
