Dupin set for release after victim recants assault allegations

In April of last year, Bobbie Dupin was charged with first-degree assault and taken into custody after he allegedly assaulted a woman with brass knuckles, in Christian Circuit Court on Wednesday the alleged victim recanted her report of assault.

Dupin’s defense attorney, Darin Higgs says the alleged victim was present in the court room and signed an affidavit saying that she made a false report when she accused Dupin of assaulting her.  

With the victim recanting her report, Assistant Commonwealth’s Attorney Mark Gilbert says he does not have much of a case against Dupin, but will look into calls Dupin made from the jail to make sure he is not missing anything.

With the victim present in the courtroom, Circuit Court Judge Andrew Self ask her questions regarding the possible release of Dupin. Self asked her a few questions regarding her safety if Dupin were to be released and if she has any objections to his release and the alleged victim had no objections and did not believe her safety would be at risk.

After he questioned the alleged victim, Self approved Higgs’ motion for Dupin’s release.

Dupin will reappear in court on February 28 for a final determination regarding his assault case and for sentencing for a separate charge of possession of methamphetamine.
