Man who stabbed brother has sentence probated, will serve time in Arkansas

A man who stabbed his brother in the ear during an altercation in January will serve time in an Arkansas prison, but it won’t be for the local assault.

As previously reported, Joshua Rush was indicted for first-degree assault, but he entered an Alford plea in November to the amended charge of assault under extreme emotional disturbance as part of a deal that came with a recommended sentence of two years.

Commonwealth’s Attorney Rick Boling said Wednesday that Rush’s brother wanted his sentence to be probated, because it would allow him to only focus on dealing with his unrelated Arkansas sentence.

Judge Andrew Self granted the request, noting Rush’s brother has been generous to him in the ordeal.

Rush will be transferred back to Arkansas to serve his time there.
