Arguments to be heard for motion to dismiss in Pembroke triple murder case

A motion has been filed in the Pembroke triple murder case against Christian “Kit” Martin to dismiss the charges, and a hearing has been set for December.

The motion to dismiss was filed by defense attorney Tom Griffiths, who represents Martin in the Christian Circuit Courtroom of Judge John Atkins, who requested a hearing be set to allow for oral arguments.

Judge Atkins set a hearing to hear arguments and discuss evidence for December 14 at 9 a.m., and he told counsel that if any other motions are filed, they can be addressed then.

Assistant Attorney General Barbara Whaley says she doesn’t expect their position to change, but they are willing to argue it in court.  Griffiths says all evidence in the case seems to have been turned over to his team.

Martin is currently lodged in the Christian County Jail on a $3 million bond for charges of three counts of murder, arson, attempted arson, first-degree burglary and three counts of tampering with physical evidence. Each count of the indictment alleges Martin acted “alone or in complicity with others or another.”

On November 18, 2015, Calvin Phillips was found shot to death in his home located on South Main Street in Pembroke. The bodies of Pamela Phillips and their neighbor, Edward Dansereau were found a few miles away in a corn field near Rosetown Road in a burned up car owned by Mrs. Phillips.  Martin could face the death penalty, if convicted.
