After reviewing new information in the case against shooting suspect Devon Poindexter, he has been released from custody on an ankle monitor as further investigation takes place.
Poindexter was accused of shooting Benjamin Murray at a party on East 14th Street in May, but new information has the Commonwealth questioning on who had a gun in their possession that night and if Murray may have possibly shot himself. Defense attorney Jason Holland requested that his client be released on an ankle monitor with that information in mind, saying he’s always done as he is supposed to on probation and can begin working immediately.
Commonwealth’s Attorney Stephanie Bolen says in light of the new information, her office will be reviewing the case, to determine if Poindexter should be the defendant on the charges he is currently indicted on, including first-degree assault, first-degree wanton endangerment, tampering with physical evidence and possession of a handgun by a convicted felon.
Judge John Atkins released Poindexter from custody, with the restrictions that he can only be at home, work, go to the doctor or church services. His next pre-trial conference was set for October 25.
