Indictments could be dismissed for two suspects in 2021 shooting case

Two of the three men charged in connection with a shooting incident that happened after a party at the Princess Theater in November of 2021 could see their indictments dismissed.

Hopkinsville police charged Jaquavian Spencer with first-degree assault after he had been accused of shooting Zamarius Humphries in the neck after Humprhies allegedly pointed a gun at him.

In court Monday morning defense attorney Sands Chewning said Humphries and Spencer have signed affidavits denying that account of the story, each providing statements that could exonerate each other in the case.

Gunfire at the same disturbance led to the death of Aniyah Collins, who was in her car attempting to leave the area.

Hopkinsville police charged Deovion Day of Cadiz with Collins’ murder and his gunfire also hit 30-year old Gteria Acree, who was in a parking lot at the corner of East Eighth and Virginia Street. Acree had to be treated at a local hospital.

Commonwealth’s Attorney Stephanie Bolen says the case file left to her from the previous administration is unclear in some areas and she requested some time to further investigate all of the details of the incident before any potential dismissal.

Spencer and Humphries were scheduled for another hearing next Wednesday, but Judge Andrew Self said Bolen can submit a motion for dismissal between now and then if she finds that prudent.

Humphries is currently charged with attempted first-degree assault and possession of a handgun by a convicted felon.
