Trial date set, special prosecutor appointed in McHenry Street murder case

There is now a special prosecutor in the murder case against Robert Torian, the man accused in the 2019 shooting death of Terrill Moore on McHenry Street.

Dennis Foust is the Commonwealth’s Attorney in Calloway and Marshall counties, and he will serve as the special prosecutor in the case against Torian, who is charged with first-degree murder. Foust agreed in Christian Circuit Court Wednesday that they needed to set a trial date as soon as possible, as this case has been delayed several times at this point.

Defense attorney James Chamberlain once again requested a bond modification, saying it’s not the fault of his client that proceedings have been drawn out.

Circuit Judge Andrew Self says he feels confident that Foust will be ready to go to trial on the agreed upon new date in September, and denied the request.

A pretrial conference was set for August 9, with Judge Self impressing upon both parties the importance of giving this case a little priority, as it has been ongoing for quite some time.

Torian is charged with murder for allegedly shooting and killing Moore during an argument that began inside a car on McHenry Street in August of 2019.
