The man recently re-indicted for second-degree manslaughter in relation to a fatal drug overdose in 2021 was re-arraigned on those charges in Christian Circuit Court Wednesday.
Seth Henderson is represented by defense attorney Olivia Adams, who entered a not-guilty plea on his behalf, telling the court she still has possession of most of the evidence in this case.
Henderson is facing charges of second-degree manslaughter and trafficking in fentanyl—he and his co-defendant, Joshua Long, were accused of selling narcotics to 23-year-old Corbin Bowling of Crofton, who would die of a drug overdose in early 2021. Long entered a guilty plea in February to an amended charge of possession of a controlled substance as part of a plea deal that required him to testify against Henderson, should he go to trial.
The charges against Henderson were dismissed in May after attorney Olivia Adams successfully argued to Judge Andrew Self that Commonwealth’s Attorney Rick Boling knowingly or intentionally presented false or misleading testimony to the grand jury regarding text messages in the case. There was testimony in the original grand jury proceedings about a text message exchange that all parties later acknowledged Henderson was not a party to and that incorrect dates were given.
That means the new case has a special prosecutor in Logan County Assistant Commonwealth’s Attorney Nate Beard, who is the one that presented the case that led to the most recent indictment. A pretrial hearing was set for January 11.
