Assault suspect incompetent to stand trial, will be admitted to WSH

The felony assault charge has been dismissed against the man accused of severely injuring a woman during an assault at a South Virginia Street apartment in January, as he is not competent to stand trial.

Thirty-six-year-old Isaac Benjamin allegedly caused major injuries to a 43-year old Pembroke woman during the assault, including multiple broken bones.

Benjamin was taken to the Kentucky Correctional Psychiatric Center earlier this year, where he was deemed incompetent to stand trial.

Assistant Commonwealth’s Attorney Jerad Smith and defense attorney Eric Bearden both agreed to the results of the report Monday morning and Judge Andrew Self signed an order dismissing the first-degree assault charge and committing Benjamin to Western State Hospital.

Bearden says he’ll waive an evidentiary hearing that would have been required to move the process along as efficiently as possible.

The order signed by Judge Self says it’s unlikely Benjamin will regain competency.
