Pretrial hearing set for Glass Avenue robbery suspect

One of the suspects in the armed home invasion at the residence of Charles “Birddog” Paige is moving forward now that his attorney represents him in all of his current cases.

Marshall Austin—who is charged with first-degree robbery—is represented by defense attorney Olivia Adams and they appeared in the Christian Circuit Courtroom of Judge John Atkins Friday morning.  Commonwealth’s Attorney Rick Boling requested a pretrial hearing be set for late November, but Adams argued that was too long of a delay—Judge Atkins set it for November 9, saying if they resolve things before then they’ll set one sooner.

Austin has four codefendants in the robbery case— Korey Zivotin, Isaiah Campbell, Michael Sims and Ajaizion Johnson—and they are accused of entering the home of Paige on June 16 while brandishing a firearm with the intent to commit a robbery. Gunfire was exchanged between the suspects and Paige, with no one injured in the incident.

The suspects are also accused of conducting reconnaissance and planning before the home invasion occurred.
