Probation was denied Wednesday morning in Christian Circuit Court for Demario White, who injured two people in a shooting incident the day before Thanksgiving last year on East 18th Street.
White entered an Alford plea in May to two-counts of assault under extreme emotional disturbance, possession of a firearm by a convicted felon, first-degree wanton endangerment and tampering with physical evidence.
He shot 28-year old Devaunte Hampton in the leg at 1200 East 18th and fired a shot that grazed a female victim, causing her minor injuries.
Attorney Olivia Adams argued for Judge John Atkins to grant probation, asserting that White was defending himself against a man who was attempting to break into his home.
Commonwealth’s Attorney Rick Boling noted the woman who was injured was not part of any break-in and reminded the judge that White shouldn’t have owned a gun as a convicted felon.
Ultimately, Judge Atkins sentenced White to 10 years in prison, saying probation would depreciate the seriousness of the crime.
