The murder charge against Deovion Day is now heading to a Christian County Grand Jury for consideration following a preliminary hearing in Christian District Court Monday afternoon.
Day is facing charges of first-degree murder, assault and possession of a handgun in relation to a fatal shooting that occurred outside of the Princess Theater in Hopkinsville in November. He is accused of firing a gun and shooting Aniyah Collins and a second victim, Gteria Acree—Hopkinsville Police Detective Robert Stucki testified that Collins was declared deceased at the scene.
Detective Stucki says Day was identified by witnesses on scene, who said 21-year old Zamarius Humphries pulled a gun on 27-year old Jaquavian Spencer and that Spencer then pulled his own gun and shot Humphries in the neck and that’s when Day began firing.
Day’s defense attorney, Daniel Whitley, argued that the charge shouldn’t be murder, it should be amended to manslaughter, as Day had not set out with intent to kill anyone.
Judge Foster Cotthoff determined there was probable cause and sent the case to the grand jury for consideration of indictment.
Hopkinsville Police continue to ask for the public’s help to locate Spencer, who is sought for first-degree assault and possession of a handgun by a convicted felon, and Humphries for attempted first-degree assault and possession of a handgun by a convicted felon.
