A new trial date was set and an attorney has withdrawn in the murder case against Robert Torian, who is accused in the 2019 shooting death of Terrill Moore.
Torian had been set to go to trial on January 10, but defense attorney Hannah Peveler filed a motion to withdraw from the case, telling Judge Andrew Self that Torian has failed to work with his attorneys and has threatened to take legal action against her. She says she feels it would be not just in her best interest, but Torian’s, if she were to withdraw.
Judge Self says he normally would deny the motion, but due to the circumstances and the fact Peveler was serving as pro-bono counsel, he did grant her motion to withdraw.
That means he also granted the second motion, filed by defense attorney Jason Byrd, to continue the case from its January trial date. A new trial date was set for June 6, to allow Byrd time to find a second attorney to assist him at trial.
The original arrest warrant from Hopkinsville police says Torian and Moore had been in an argument while both were passengers in a vehicle on McHenry Street in August of 2019. Torian was in the back seat when he exited, opened the front passenger door and allegedly shot Moore in the head.
