A request for shock probation was denied Wednesday afternoon for the gunman in the September, 2018 shooting death of Jerry Robertson on State Line Road near Allensville.
Daniel Westbrook pled guilty in February to second-degree manslaughter and possession of a handgun by a convicted felon, with the deal coming with a 10-year sentence—the maximum for that charge.
Court officials say Robertson’s mother testified at Wednesday’s hearing and pled with Judge Joe Hendricks to deny the motion for shock probation.
Judge Hendricks left Westbrook in jail and his next chance to get out will likely be when he comes up for parole in September.
