The alleged gunman in the September, 2018 murder of Jerry Robertson on State Line Road near Allensville appeared in Todd Circuit Court Wednesday as he awaits a potential March trial.
Daniel Westbrook is charged with murder and possession of a handgun by a convicted felon and his trial date of March 16 could be in doubt if evidence testing isn’t complete soon.
Commonwealth’s Attorney Neil Kerr told Judge Joe Hendricks that he’s waiting on a ballistics report and he’ll hand it over to defense attorney Nate Beard as soon as it’s complete.
Beard says he’ll need time to look over the report to determine if he needs an expert once that report is received.
Another pre-trial conference was set for Wednesday of next week to determine the status of the case.
Westbrook’s four co-defendants have all accepted plea deals in the case and could testify if his case goes to trial.
