Man gets life plus 40 years for brutal rape

Following several days of trial in Christian Circuit Court, a jury has found James Hinman II guilty of three count of first-degree rape, including one count with serious physical injury, for an attack that happened in 2013.

According to court documents, the guilty verdict comes with a recommended life sentence on one count, plus 40 years for the other two rape counts. Those sentences would run consecutively, as recommended by the jury.

The 39-year old Hinman is convicted of attacking the female victim in 2013 after she said no to his sexual advances, striking her repeatedly with punches, kicks and jumping onto her with his full body weight until she passed out.

He then woke her and made her put on a dress that belonged to her daughter and raped her, while calling her the daughter’s name and looking at a picture of the daughter. The victim was able to escape two days later following additional attacks, along with her children. She went to the hospital, where it was determined she had a concussion and severe bruising and abrasions on her body.

Hinman went to trial previously in 2014 and was found guilty of first-degree rape and second-degree assault. An appeal overturned the rape verdict, and the Commonwealth brought new charges against Hinman in 2017.
