The family of an Eddyville toddler who died in flood waters at Cummins Falls State Park is claiming negligence by the State of Tennessee.
Steve Pierce was swept away when water rose as his family was trying to cross the river last month. The family’s attorney is asking for a settlement from the state and the Department of Environment and Conservation.
The letter lists a number of factors for claiming negligence, including the state’s failure to install a warning system after the deaths of two people in 2017.
