Man charged with 4th DUI jailed again after coming to court with alcohol in system

A man appearing for arraignment on a fourth DUI charge in Christian Circuit Court Wednesday morning was arrested again after testing positive for having alcohol in his system while in the courtroom.

Court officials notified Circuit Judge John Atkins that 55-year old Robert Ervin appeared to be under the influence and the judge ordered him to undergo a breathalyzer test. A bailiff returned with Ervin in handcuffs and said Ervin would not blow into the device long enough to determine a blood alcohol content, but Mike Walker with the adult drug court said the test did show the presence of alcohol.

Judge Atkins ruled that Ervin had violated conditions of his release and revoked his bond, remanding him into custody.

Ervin is charged with driving on a DUI suspended license and possession of an open alcohol container, in addition to his fourth DUI.
